I suspect this only occurs if you attack them unprovoked but I haven’t checked
After checking, I have found it only occurs if you attack them without paying 200 gold and the steel watcher attempting to arrest you.

Another oathbreaking action[edit source]

If you attack Omeluum as soon as you see him by dialogue choice in Act 1 (gith's option in my experience), then oath become broken too

After checking, I have found it only occurs if you attack them without paying 200 gold and the steel watcher attempting to arrest you.
